Terms & Conditions

NetBop Technologies Ltd provides webpage authoring, custom scripting, World Wide Web page hosting and forwarding. NetBop Technologies Ltd reserves the right to suspend or cancel a customer's access to any or all services provided by NetBop Technologies Ltd when NetBop Technologies Ltd decides that the account/services has been inappropriately used or otherwise.

WEBPAGE AUTHORING

NetBop Technologies Ltd offer webpage authoring on a quote basis. NetBop will inform you in writing with a pricing estimate to reach your requirements prior to undertaking any work. An alteration during and after work has been undertaken could increase charges and you will be informed of an hourly rate in this case. All HTML, JPG, GIF and MDB content remains the customers property and a copy can be requested on CD-ROM for a nominal fee.

CUSTOM SCRIPTING

All scripts written by NetBop Technologies Ltd for a customer remain property of NetBop at all times and are loaned free of charge to customers while NetBop maintains control of the website. This includes all pages written in Active Server Pages (ASP). Release of NetBop scripts for use by another provider will require a release fee. All scripts written by NetBop Technologies Ltd are bespoke systems and are designed to work on Windows NT/2000 servers only. A release of scripts may entail scripting fees to enable scripts to work on any server. After a script has been released no ownership tags must be removed in the coding.

STATISTICS

NetBop's statistical analysis is generated in real-time and does not guarantee total accuracy in data received. Your statistics are also available in Microsoft Access Database (excluding Matrix Stats users) format at any time for a nominal fee.

CONTROL PANELS

NetBop Technologies Ltd takes no responsibility for actions taken by yourself which may cause shopping cart scripts to function incorrectly. NetBop Technologies Ltd will not be held responsible for any costs incurred as a result of your actions.

SERVER USE

Business accounts are to be used by the primary owner only. Business account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

NetBop Technologies Ltd reserves the right to refuse service and /or access to its servers to anyone.

NetBop Technologies Ltd do not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of NetBop Technologies Ltd.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

UNLIMITED USE POLICY

High bandwidth usage: NetBop Technologies Ltd offers very large ratios of bandwidth per customer. In rare cases, NetBop Technologies Ltd may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. NetBop Technologies Ltd therefore imposes a limit of 2Giga Bytes of transfer within the period of 30 days. In such instances, NetBop Technologies Ltd reserves the right to impose the High Resource User Policy for the consideration of all customers.

HIGH RESOURCE USER POLICY

Resources are defined as bandwidth and/or processor utilization.

NetBop Technologies Ltd may implement the following policy to its sole discretion:

When a website is found to be monopolising the resources available NetBop Technologies Ltd reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby NetBop Technologies Ltd continues hosting the website for an additional fee.

PAYMENT POLICIES

All accounts are set up on a prepay annual basis. Exceptions to this may include monthly management fees. Although Net Bop Technologies Ltd reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year following the date the account was established. Customers will automatically be invoiced again 30 days prior to the end of their prepay period unless closure notification has already been given. Failure to clear any outstanding balance within 40 days of the invoice date, will result in a temporary suspension of services and a penalty of £35.00 will be incurred. A non-refundable deposit of 25% of a project value is required before NetBop undergoes work for any website/script. NetBop Technologies Ltd reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request. All payment is in UK sterling.

CANCELLATION AND REFUNDS

NetBop Technologies Ltd reserves the right to cancel the service at any time. Customers may cancel their account at any time. In both events customers will be entitled to a pro rata refund -20% based upon the remaining period of membership. If a customer contravenes NetBop Technologies Ltd’ terms of service a refund will not be issued in the event of a cancellation. In addition some accounts incur set-up fees, these charges are also non-refundable. (Eg: SSL, Statistics & Control Panels)

INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold NetBop Technologies Ltd harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against NetBop Technologies Ltd, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless NetBop Technologies Ltd against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with NetBop Technologies Ltd server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from NetBop Technologies Ltd server.

DISCLAIMER

NetBop Technologies Ltd will not be responsible for any damages your business may suffer. NetBop Technologies Ltd makes no warranties of any kind, expressed or implied for services we provide. Net Bop Technologies Ltd disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by NetBop Technologies Ltd and its employees. NetBop Technologies Ltd reserves the right to revise its policies at any time.
